Submission:

I believe the "red areas" are result of a conservative approach to construction. It may help in simplification of the turn protection area construction. I agree with the philosophy laid by ASAP from the logical point of view (the "worse" aircraft position). However the red marking "before" reaching the fix value is incorrect as indicated by Henrique.

As for the illustrations, the fix tolerances are quite large (looks to be some 3NM) perhaps to mark the problem. In reality I would prefer a better fix configuration. It corresponds with Mr. Kogojs reply. He also mentioned the 23° limit of DME divergence. I would point to the fix area length, which maybe worse when providing intersection by a distant VOR or NDB (which is not limited) rather than intersecting by DME distance divergence of more than 23°. The only limitation is one of fix tolerance length.
